Chair Kalliope Egloff called the meeting to order at 6:00 PM.
NEW BUSINESS
1. Request for Decision: Bridges of Mashpee, Request for Altering Requirements of Water Quality
Report.
Glen Harrington commented that the Mashpee Planning Board requires a Water Quality Report be performed when a Special Permit is amended or required on commercial properties. Tom Fudala, Mashpee Town Planner, has said that the Mashpee Planning Board did not expect additional wells to be installed at the Bridges of Mashpee property. The Cape Cod Commission is requiring monitoring wells for the septic system, and the Mashpee Planning Board thought the septic wells were sufficient to meet the requirements of the Water Quality Report. However, it is up to the Mashpee Board of Health to make the decision regarding the wells, the location, and sampling analytes not the Planning Board.
The engineer from Stantec requested a waiver of the wells with the following reasons:
- A Phase 1 Environmental Site Assessment was conducted at the property and concluded no evidence of contamination.
- The project only proposes development of approximately 5 acres of commercially zoned land, which is less than the 10 acres of development to trigger the Water Quality Report. The Mashpee Planning Board is still requiring the Water Quality Report.
- The Cape Cod Commission has required through a draft proposal that 3 monitoring wells be installed for regular testing, monitoring, and reporting for the septic system.
Mr. Harrington stated that he was aware the wells were installed on this property for the Shaw’s Supermarket project in 2001. Per Mr. Harrington’s request the designer of a previous plan for the Planning Department, Rizzo Associates, forwarded a plan of the property showing the locations of the wells, that it had been surveyed, and a section of the Cape Cod Commission filing that showed Horsley Witten Group had taken samples from the installed wells. Joe Longo from Horsley Witten Group provided the well logs and the sample analysis taken from those wells in 2001, offering a baseline of information for the groundwater monitoring wells.
Lucy Burton made a motion that the Board of Health approve the variance as requested for 482 Old Barnstable Road for the Water Quality Monitoring Wells with the condition that no further additional monitoring wells and the installation of the wells for the septic system be installed, sampled, and tested per the Cape Cod Commission requirements thereafter. The existing wells installed for the Shaw’s Supermarket project should be located, surveyed, and protected for future use. Burton Kaplan seconded the motion. The motion was unanimously approved.
NEXT MEETING
The next meeting of the Board of Health is scheduled for Thursday, March 6, 2014, at 7:00 PM. As there was no further business, Lucy Burton made a motion to adjourn the Public Session Meeting of the Board of Health at 6:06 PM. Burton Kaplan seconded the motion. The motion was unanimously approved.
